By your use or use by your minor child of this site, you are deemed to be certifying, acknowledging, and agreeing to the following terms.
I certify that I am the adult parent or guardian of the minor child under the age of eighteen years participating in Camp Kinda, a free, at-home on-line experience (the “Program”) presented by EdNavigator, Inc., a Delaware not-for-profit corporation (“EdNavigator”), and I consent to his/her participation in the Program.
I understand the risks associated with my minor child’s participation in the Program and I agree, personally and on behalf of the minor child participating in the Program, to assume all the risks and responsibilities surrounding my minor child’s participation in the Program.
IN CONSIDERATION OF THE SERVICES TO BE PROVIDED AND EXPENSES TO BE INCURRED BY EDNAVIGATOR IN CONNECTION WITH MY CHILD’S PARTICIPATION IN THE PROGRAM, TO THE FULLEST EXTENT ALLOWED BY LAW, I HEREBY RELEASE, FOREVER DISCHARGE, WAIVE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO HOLD HARMLESS AND INDEMNIFY EDNAVIGATOR, ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, OR REPRESENTATIVES, AND ANY VENDOR CONNECTED WITH THE PROGRAM, OR ANY OTHER PARTICIPANT IN THE PROGRAM, FROM AND AGAINST ANY AND ALL PRESENT OR FUTURE CLAIMS, CAUSES OF ACTION, DEMANDS, LOSSES, LIABILITIES, OR ACTIONS, WHETHER IN LAW OR EQUITY, FOR INJURY TO PERSON OR PROPERTY, WHICH ARE RELATED TO, ARISE OUT OF, OR ARE IN ANY WAY CONNECTED WITH MY MINOR CHILD’S PARTICIPATION IN THE PROGRAM, RESULTING FROM ANY CAUSE WHATSOEVER, AND REGARDLESS OF FAULT, WHETHER ON MY OWN BEHALF OR ON BEHALF OF MY MINOR CHILD, SPOUSE, HEIRS, ASSIGNS, OR PERSONAL REPRESENTATIVES.
I am at least eighteen years of age and have carefully read and freely agreed to this Release and Waiver of Liability Agreement. I understand and agree that no oral or written representations can or will alter the contents of this document.
I understand and acknowledge that, at the sole discretion of EdNavigator, my minor child may forfeit participation in the Program and that he/she may be asked to remove him/herself from some or all of the activities associated with the Program if his/her actions are disruptive to, or interfere with, safety, comfort, or enjoyment of others in the Program.
